Carnahan can use legal expense fund for Fox suit

JEFFERSON CITY, MO. -- The Federal Election Commission ruled that Robin Carnahan can organize a legal defense fund to cover costs related to a copyright lawsuit filed by the Fox News Network.

Carnahan can use the fund to cover $85,000 in costs stemming from the suit. The lawsuit was recently settled with both parties paying their own attorney fees.

The suit was brought by Fox during Carnahan’s unsuccessful U.S. Senate campaign last year. Fox said Carnahan used footage from a 2006 interview by Fox News journalist Christopher Wallace with Republican Roy Blunt. Fox said it was copyright infringement and a misuse of Wallace’s image.

Carnahan’s campaign defended the use of the ad, but removed it from Youtube. The ad still ran on Carnahan’s election website as well as television.

In their decision, the Federal Elections Commission said Carnahan could set up the fund and it would not be subject to contribution limits for a federal candidate.
