Charges against Dale Helmig dismissed

Osage County Prosecutor Amanda Grellner will not retry murder charges against Dale Helmig. At least, not for now.

Grellner said in a news release that she took the time during the appellate process to review the case and consult with area law enforcement agencies.

"I have decided to dismiss the case at this time, however, there is no statute of limitations for the crime of murder," Grellner said in the news release. "This case remains an open and ongoing investigation."

Grellner said if new information becomes available, it will be reviewed with the current case file to determine whether to re-file charges against Helmig.

Helmig's attorney, Sean D. O'Brien sent the news release, provided to him by a local media outlet, and said the defense received notification of the decision around 6 a.m. Sunday.

The decision means Helmig will remain free unless Grellner chooses to file new charges in the future.

Helmig was convicted in 1996 of killing his mother at her Osage County home. He was sentenced to life in prison without parole at the time, but in 2010 a judge overturned that conviction, citing Helmig's innocence in the case.

The state appealed the decision in hopes of keeping Helmig in jail. A judge later ruled for Helmig's release.
