(AP) -- A second special prosecutor has decided not to file criminal charges against Moberly police in the 2008 death of a suspected drunken driver killed after he was shot with a Taser stun gun.
The decision by Columbia attorney Milt Harper follows a similar finding by Howard County prosecutor Mason Gebhardt in 2009. Both were appointed by the Randolph County prosecutor to avoid a conflict of interest
Twenty-three-year-old Stanley Harlan died in August 2008 after Moberly police officers stunned him three times during a traffic stop. His family won a $2.4 million legal settlement with the city of Moberly in June 2009.
Harper found "negligent conduct by police" but noted that "civil negligence is not the same as criminal conduct."
