A man allegedly pushed into a concrete wall by a former Columbia police officer plans to file a federal lawsuit this week.

Ken Baker, 38, claims former Columbia Police Officer Rob Sanders broke his back during a confrontation in a holding cell.

Columbia Police released a surveillance video of the confrontation between Sanders and Baker.  After being pushed into a holding cell wall, Baker spent 4 days in the hospital with a fractured vertebrae and wounds to the back of his head.  Baker's Attorney Ron Netemeyer plans to file a federal lawsuit against Sanders for violations of civil rights sometime this week.  A 39-page internal affairs investigation cleared Sanders of using excessive force and not providing medical attention.

Netemeyer said, “What really concerns me about the internal affairs investigation is that it basically condones the behavior of Officer Sanders.  It says that when you enter a holding cell and you have a defenseless person there and you break his back, that’s all proper policy and procedure for the Columbia Police Department.  That’s equally as troublesome as the fact that Rob Sanders did it in the first place.  That’s a great concern to me.”>

Sanders is appealing Police Chief Ken Burton’s decision to fire him and has the support of the Columbia Police Officers’ Association.

Netemeyer said Baker is still under a doctor’s care and wants the city or Sanders to pay a long list of doctor bills.

Sanders is also the subject of 2 other internal investigations involving another confrontation in a holding cell and an incident involving a motorist.
