State fights Helmig release

Convicted killer Dale Helmig, who was declared innocent by a DeKalb County judge, may not be released from prison anytime soon.

Missouri's Attorney General Chris Koster is contesting a request for bail while the state seeks to have to have the trial court's innocence ruling overturned.

The Osage county man is serving a life sentence for killing his mother.

There is no precedent in a case like this, but Helmig's attorney Sean O'Brien points out this is the first time the state has appealed a trial court order finding that a prisoner has proved his innocence,  citing the cases of Joe Amrine and Josh Kezer.
