JEFFERSON CITY, MO -- Update: Wednesday, Oct. 27 at 12:27 p.m.

Cole County Prosecutor Mark Richardson obtained a grand jury indictment for the man suspected of shooting a 9-year-old’s puppy.

Michael Rollins of Jefferson City, was charged with unlawful use of a weapon.

Update: Thursday, Oct. 14 at 3:36 p.m. 

The Jefferson City Police said that the case is being investigated. Police are talking to witnesses and gathering more evidence.

Jefferson City Police Randy Dampf said that the paperwork will be filed with the prosecutor’s office within the next day or two.

The Cole County Prosecutor’s office said that it has not received paperwork in the case of a man suspected of shooting a dog from Jefferson City Police.

As of Thursday afternoon, no charges have been filed against the suspect.

Police went back to the scene after KRCG covered a story about a boy's best friend, being shot by the neighbor.

"I was walking my dog and I walked him down the hill,” 9-year-old dog owner Jerry Adams said. “There was another person and he had a dog. I was holding on to [the dog] and he pulled out a gun and shot him."

Now, Jerry and his family want justice.

The Adam's family said their neighbor should be charged with a crime after shooting the family's pit bull, Echo.

Police said the 57-year-old man said he shot the dog in self defense.

However, police said they are investigating the case to figure out exactly what happened.

"There are a lot of things still at play and everything is still, I guess, fair game in terms of what may be the outcome,” Jefferson City Police Capt. Doug Shoemaker said. “So we make sure we do it properly, we have to look at every possible aspect of what could have taken place."

Shoemaker said that the 57-year-old man told police that the boy lost control of the dog and that the dog charged him.

Jerry’s mother said that's not the case.

"The leash was two feet long. The dog was on the leash,” Jerry's Mother Joy Adams said. “He was standing right next to him. From what my son told me, he pointed the gun at him, cocked it, said I’m going to shoot your dog; and turned the gun on the dog and shot him."

Shoemaker said what KRCG reported Tuesday evening helped officers learn more about the incident.

"Sometimes people are more apt to say something to the media that they won't say to the police,” Shoemaker said. “But that helps us because then we can say okay they said this to them, maybe we can find out more about it. So that actually helps us to maybe flush the case a little bit more."

Police did take the man's gun away from him. But wouldn't say if he had a conceal and carry permit.

As of Tuesday night the neighbor has not been charged with a crime.

The prosecuting attorney said he is still waiting for paperwork from police.

Police originally said they would ask the prosecutor to charge the man with unlawful use of a weapon.

Police also said that it's too early to tell if the man could also be charged with child endangerment.

Police also want to make it clear that this was an isolated incident and that other pets are not in danger.
