KANSAS CITY, MO. -- A panel of judges for the Western District Court of Appeals denied Ryan Ferguson’s latest appeal.

Ferguson wanted to send his case to a trial court to see if he should get a new trial.

According to Tuesday’s court opinion, the judges rejected it because under Missouri Law Ferguson is not allowed to file another motion for a new trial at this time.

However, in the judgment, the judges mentioned he could go after a Habeas Corpus review in the future, which could bring him before a Cole County judge. It's possible because of new testimony from Chuck Erickson.

Earlier this year, Erickson said he alone killed Kent Heitholt and that Ferguson just watched.
