Update: Trial begins for former lawmaker accused of sexual assault

COLE COUNTY -- Update: Thursday 6:20pm:

A prosecutor opens the trial of a former St. Louis-area lawmaker by describing how the lawmaker touched his penis to the hand of a then 14-year-old girl.

Scott Muschany, a Republican from Frontenac, faces a felony charge of "deviate sexual assault" and a misdemeanor of exposing his genitals to a minor.

The expected two-day trial started Thursday.

Prosecutor Anji Gandhi says the girl woke up in the middle of the night and felt her hand touching a male penis. The accuser is not being identified because The Associated Press generally does not identify the victims of alleged sex crimes.

Muschany's lawyer, Robert Haar, said the married former lawmaker had a two-year affair with the victim's mother. But Haar called the accusation against Muschany "absurd."

The trial of former a state representative accused of sexual assault begins this morning in Cole County.

A Clay County jury was imported to hear the case against Scott Muschany, 42, of Frontenac, Mo..

Last year, Muschany plead not guilty to an indictment by the Cole County grand jury that he had "deviate sexual intercourse" with an underage partner.

A grand jury indictment claims the encounter occurred just after the legislative session ended in May.

The St. Louis Post-Dispatch says the victim is the 14-year-old daughter of a state worker-who admitted to having a romantic relationship with Muschany herself for more than a year.

Muschany faces up to seven years in prison if convicted.
