19-year-old accident victim speaks out on wrongful death lawsuit filed against her

"I have flashes of the EMTs standing over me, but that's the last thing I remember until the next Saturday, when I was in the hospital," recalls 19 year-old accident victim Emily Frakes.

On the road, in a second.... lives can be changed.

That's what 19-year-old Emily Frakes and her family have learned first hand over the past month and a half.

"I mean, I don't know if I could have done anything differently. I was just driving to work, just like I do everyday," she said.

The highway patrol says it was Frakes who crossed the centerline on Highway 52 February 28th.

In the car she was in, she struck three members of the Wilcox family  who were all killed; their two-day-old baby the sole survivor.

Now the mother of one victim, Marty Wilcox, has filed a wrongful death lawsuit against Frakes.

"I understand that they're upset. If I were in their shoes, I'd be really upset. I can't imagine losing any of my family members .But...what do they expect to get out of me? I'm 19, I don't have any money, I don't even have a car anymore.”

Frakes has a child of her own, and she says she can imagine the pain the Wilcox family is going through.

"I was in the hospital...I did fight for my life. I have daily battles everyday. I can't be home alone with my daughter anymore, because I can't take care of her," she said.

For now, Frakes and her family are just taking everything one day at a time.

They say that's all can do, after what happened.
