JEFFERSON CITY, Mo. (AP) -- An attorney for Alyssa Bustamante is seeking to have her placed in a mental hospital while she faces a charge of murdering a 9-year-old mid-Missouri girl.

Online court records show that Bustamante's public defender filed a motion Thursday to have his 15-year-old client immediately hospitalized for mental health treatment.

Bustamante was indicted Wednesday as an adult on charges of first-degree murder and armed criminal action in the Oct. 21 death of Elizabeth Olten.

Authorities say Bustamante confessed to digging two holes, then killing Elizabeth five days later. They say Bustamante later led them to Elizabeth's body in a wooded area near their homes in St. Martins, just west of Jefferson City.

What She Is Really After

The Department of Mental Health will file for a longer stay so they can evaluate her longer. I see this happen all the time. It never stays at 96 hours. She will be at the hospital for months if not a year or two or longer until the hospital and her “private” doctors decide she is “competent” to stand trial. If she is never found to be “competent” then the Judge will say she is NGRI (Not Guilty by Reason of Insanity). This is the ultimate goal her attorney is after. If she gets her NGRI the Judge will commit her to the care of the hospital until a panel of doctors determines she is “cured” or can live in the community, most likely supervised. This process can be as little as 6 years or as much as 25 or longer if need be. But in the eyes of her attorney this is better than the death penalty or life behind bars! And most persons prefer the stay at the “Hospital” instead of “Prison” because they are not treated like “Prisoners” but rather “Patients”. And don’t even get me started on that! News 8 just did a story on employee injuries at the hospital….

Big diff between mentally ill and criminally insane.

There is a world of difference between being mentally ill and being "insane". Insane is an outdated word that is not even a medical diagnosis anymore. She is obviouslly mentally ill, but not to the point of someone who is delusional or suffering from psychosis. I'm sure she is probably going crazy with the realization of what she has done and I can see how she could be suffering from a complete mental breakdown right now. I think a mental hospital is the best place for her, they aren't exactly the Holiday Inn or anything, they are not fun places to be. She is disturbed. Again not using it as an excuse, as I think she had full knowledge of what she was doing and should be punished to the fullest extent of the law but people do need to understand mental illness better. Mentally ill does not mean the same thing as insane. Insane people do not get A's & B's and attend school regularly, etc. She is not insane, but she is mentally ill.

There are thousands of words that could be said about the photo of Alyssa with the gothic make up on her face which is disgusting and completely unattractive I want to throw up when I look at it and pointing her fingers to her head like a gun...

BUT, I guess you don’t have to explain this photo to the world, when it's all right there. And if it wasn't for those ‘people’ that have a problem with people stating their opinions and being, honest!! Then I would tell you the thousand words to this photo.

Overused plea!

I actually think the same. the "insanity plea" is overused. its not fair for everyone to use that as an excuse. of course something isnt right in her head..but not enough to take the "insanity plea" or judge beetem would have addressed that. I know him personally. He is an great man, and judge. He will make sure the right thing is done in this case. He has been in the system for years, he knows.

But I personally think that if alyssa was mentally ill to the level of being able to use the plea, he would of done so by now. we all know she is mentally unstable, obviously for what she has done. I have no fears bc i know that beetem will make sure justice is served.

Judge Beetem is a great judge for this case.

If you would read the article, it says nothing about her attorney pleaing anything. The attorney simply has asked for her client to be placed in a mental hospital for treatment while she is facing murder charges. Please remember that this is a child that killed another child. She obviously has a serious problem and does need the help. That's not to say that she doesn't also need to be held responsible for the crime she has committed. She does. She needs to get help also, and if someone is willing to get her that help while she is waiting to be tried for her crime, what is the problem with that?

Mental Hospital

Anyone who takes the life of another person is crazy. Why should she be any different? I'm sick and tired of the insanity plea that so many use. Are facilities are crowded with these types of individuals and I think the laws need to be changed. Make it harder for this plea to be used. She's guilty and should be punished!

Are yoou freaking kidding me?! how did i guess? 15 year old killing someone, with intentions of killing 2 is mentally ill? no way!

no, seriously. she had plenty of time and planning for this. she knew that it was wrong. that is why she disposed of the body so well. if this does go through where they do send her to a mental hospital..what happens? will she be free at age 21 or will she still be in custody.

sorry for my sarcasm. this just baffles me.
